Can I Donate A Car To Charity – A client of mine, whose car recently “died,” told me he wanted to donate that car to charity for a tax break. I know a number of people have expressed an interest in doing the same thing with their cars, but I think it’s as simple as leaving the car with their favorite charity and then taking the tax break.

So for my client, everyone who has expressed an interest in donating their vehicle, and all of my valued readers, I thought I’d review the rules for donating a car.

I’ve seen many ads enticing you to donate your car to a charity and get a tax break, but you should be aware. . .

First, you will not get any tax benefit from donating your personal automobile to charity unless you can list Schedule A! This means that the total of your “articulated” deductions exceeds the applicable standard deduction amount. While the donation itself can put you over the top and get you to be able to list, to get the maximum tax benefit you need to be able to list without donating the car.

A few years ago a customer expressed excitement when he told me that he had donated his car to charity and that he expected to get a big tax break. Unfortunately, his tax benefit from the deduction was zero, nothing, zero. He couldn’t detail, and he hadn’t in the past, and even with the added value of the car he still couldn’t detail.

FYI: You may wish to specify whether your total deductions do not exceed the applicable standard deduction amount if you fall victim to the dreaded Alternative Minimum Tax (AMT). The standard deduction is not allowed in calculating the AMT, but an itemized deduction for charitable contributions is.

Secondly, the amount you will receive “in your pocket” will only be a small percentage of the car’s value. How much money you’ll make depends on your federal tax bracket and, if your state allows a similar tax deduction (New York does not), your state tax bracket.

And third, you have to wait to file your tax return to get the money. If you donate a car to charity today, you won’t see the money until at least next tax season.

When you donate a vehicle (car, motorcycle, boat or airplane) to a church or charity, the amount you can deduct depends on what the organization does with the donated vehicle.

(1) If the organization sells the vehicle without significant temporary use or material improvement, the tax deduction is limited to the gross proceeds of the sale.

(2) If the organization intends to use the vehicle temporarily or permanently in its operations, or make “material” improvements to the vehicle before selling it, or sell the car to an individual “in need” for significantly less than market value , or give the car to that individual, you can deduct the “fair market value” of the vehicle.

You can use the “private party value” for the vehicle, adjusted for mileage and condition, as listed in the Kelly Blue Book (www.kbb.com) or a similar used vehicle price guide. If the vehicle’s fair market value is more than $5,000.00, a formal appraisal must be obtained.

To claim a deduction of more than $500.00 for donating a motor vehicle to charity you must include copy B of the IRS Form 1098-C, provided by the charity, with the filing of the Form 1040.

Form 1098-C will include the beneficiary organization’s name and tax identification number, vehicle identification number, date of contribution, and information about what the charity did with the vehicle. Form 1098-C must be issued within 30 days of the date of the contribution or the date the vehicle is disposed of by the donor organization. The charity can provide a statement in lieu of Form 1098-C as long as it contains all of the necessary information discussed above.

After you hand in your car to charity, you should get a written receipt right away. Depending on what the charity does with your car, you will also receive a written acknowledgment or Form 1098-C (contributions from motor vehicles, boats and airplanes) at some point. Keep this document, as you may need the information to file your taxes and you may also need to submit the document itself if you are deducting
